Your contract is with Taste Rioja (hereinafter referred to as 'The Organiser', 'We', 'Ourselves', 'Us' and 'Our'), and your booking is subject to the following conditions:-

 

Acceptance of Risk - Your booking is accepted on the understanding that you realise and accept that your tour includes visits to wineries which by the nature of their working environment may present potential risks and hazards including, but not limited to, machinery in operation and wet floors. You will need to listen to the advice given to you by your guide concerning any particular risks there may be and to exercise due caution during your visits.

 

Responsibilities of The Organiser – The Organiser will accept liability for the proper performance of the obligations under the contract, irrespective of whether such obligations are to be performed by ourselves or by our suppliers of services but this shall not affect any remedy or right of action which we may have against those suppliers of services. We will accept liability for any damage caused to you by the failure to perform the contract or by its improper performance unless such failure to perform or improper performance is not due to any fault of ourselves or our suppliers of services because such failure to perform or improper performance:

i) is attributable to you; or

ii) is attributable to a third party unconnected with the provision of the services contracted for, and is unforeseeable or unavoidable; or

iii) is due to unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we ourselves or our suppliers of services, even with all due care, could not foresee or forestall;

and events which would come within the above sub-clauses include, but are not limited to, flight cancellations, strikes, wars, riots, robbery, sickness, quarantine, measures or restrictions put in place by any proper authority because of actual, threatened or potential terrorist activities, frontier disputes and government intervention.

Where the Organiser is found to be liable for damages in respect of its failure to carry out the contract, the maximum amount of such damages will normally be limited to the price paid for the tour

 

Authority on the Tour - By making your booking you agree to accept the authority and decisions of our employees, guides, agents and suppliers during the tour. If, in the opinion of any of these people, your health or conduct appears likely to endanger the progress of the trip you may be excluded from the whole of, or part, of the trip. In the case of ill-health we reserve the right to make such arrangements for your well-being as we deem necessary and to recover the whole of the costs thereof from you. If you commit an illegal act we shall cease to have responsibility for you. We remind you that the wearing of a seatbelt whilst travelling in a motor vehicle is mandatory at all times in most countries and failure to do so may result in an on the spot fine.

 

Personal Insurance – You are advised to have personal travel insurance in force during the whole of your tour and to notify your guide of your cover at the start of your tour.

 

Special Requests - Any special requests, including special dietary requests, must be communicated to us in writing at time of booking. Whilst we endeavour to fulfil these requests, we cannot guarantee to do so. Any failure to meet special requests will not be considered a breach of contract on the part of the Organiser.

 

Cancellation or Changes by the Operator - We reserve the right to cancel any tour prior to the departure date in which case any payment made by you will be refunded in full (save where cancellation is as a result of your failure to pay any monies due or of force majeure, see below). You will not be entitled to make any further claim for compensation or damages for any loss, consequential damage, expenses, loss of time or inconvenience which may result from any such cancellation.

If a major change to the booked tour becomes necessary, we will advise you of the change as soon as possible (provided that there is sufficient time to do so prior to departure). Upon the occurrence of a major change, you will have the choice of either accepting the change, substituting another available tour of equal value from us, or cancelling the tour, in which event you will be given a full refund. In the event that we notify you of a major change more than 7 days before the date of the tour you must let us know within 7 days of such notification which option you would like to accept.

We reserve the right to make changes of a lesser nature, which may include but are not limited to changes in the order or timing of visits to wineries and these will not be deemed a reason for you to cancel your booking.

A refund will not be payable if we are forced to cancel, or in any way change your trip, for reasons of force majeure; namely war, threat of war, riot, civil strife, industrial dispute, the occurrence or threat of terrorist activity, natural or man-made disaster, fire or adverse weather conditions, quarantine or other public health measures, or other similar events beyond our control or that of our suppliers.

 

Cancellation by you - Any client who wishes to cancel must do so in writing and the cost of the tour will be refunded less the following percentages based on the date of receipt in writing by the Organiser of the notification of cancellation.

Collection of data and personal information - There may be various ways of collecting information about users on this website. The information that we obtain in this way will be used to reply to any correspondence from users, and may also be used to send commercial correspondence and/or information regarding our products and services by any means of contact that any user may have given us, only if we have previously obtained permission from the user by means of the user having ticked the corresponding box, thereby expressly giving us permission to do so. Should any user wish to contact Taste Rioja, and not authorise us to send any commercial information (unless this is the reason for contacting us) then the user needs only to let us know this in the comments box of the contact form. We hereby let it be known that any user who gives us any data or personal information does so voluntarily. All the information and contact details that we receive will be dealt with according to the confidentiality and security obligations as expressed in the Data Protection Act 1998. Any information that we receive from users may be incorporated into a database belonging to Taste Rioja.  Any information on any such database may be subject to automated treatment. In all cases, Taste Rioja will have ownership of this information, and all rights of access, rectification, opposition, or cancellation of any such information must be exercised via Taste Rioja, in accordance with the applicable legislation. Authorisation and Consent: When a user has given any information for any reason, or during any contact through this website, the user thereby expressly authorises Taste Rioja to send the user information such as commercial and advertising material. If at any time the user would like to stop receiving this communication, then the user can let us know by sending an e-mail to us at jenny@tasterioja.com In this case we will contact the user to confirm that we will not send any more communication in the future.

 

Data protection - Visiting this website does not mean that the user is obliged to give any sort of information whatsoever, therefore any information that we receive is understood to have been sent voluntarily. Should we receive any personal information from any user, then this information will be used for the reasons given above, and always according to the applicable legislation.  Taste Rioja reserves the right to keep any data obtained from users even after any commercial or other relationship with the user may have ended, in order to comply with any legal obligations.

  Taste Rioja is authorised by the user to make use of the personal data information that they have received, and to carry out any computerised treatment of such data as may be necessary to be able to give the service requested by the user.  Should the information received be used for any other reason other than that which the information was offered, then the previous consent of the interested party will be required.  Taste Rioja has adopted the technical and organisational measures that are necessary to ensure that any information we receive is treated in a secure manner, and to ensure that such information is not altered or lost, or accessed or treated in any way that is not authorised.  When any information is about to be sent to us through this website, it will be made clear that such information is either voluntary or obligatory. If the information that is considered obligatory is not given, then we will not be able to offer, or the user will be unable to access, the service that is being requested.  Similarly, if any information is given voluntarily, this will be so that we will be better able to deal with any request from any user.Users whose information has been collected on a database have the right to oppose, access, rectify, or cancel this information freely, and to revoke the authorisation of the sending of commercial or advertising material, without retroactive effect, as specified in, and in accordance with, the established legal procedure in the Personal Data Protection Act 1998 . Law Applying – The agreement between us will be governed by English law and any disputes will be dealt with by the English court. Your tour will be deemed to commence and end in the country in which the tour takes place and in such circumstances where the tour commences in one country and ends in another then it will be deemed to commence in the former and end in the latter.
